The Ministry of Labour and Social Protection of the Population of the Republic of Kazakhstan explains the procedure for appealing medical and social assessment (MSA) decisions. A citizen or their legal representative has the right to request a review of the assessment decision if they disagree with the decision on the disability group, its duration and cause, or the degree of loss of working capacity.<\/p>\n

To do so, a complaint must be filed with the territorial department of the Committee for Regulation and Control in the Field of Social Protection of the Population of the Ministry of Labour and Social Protection of the Population no later than three months from the date the assessment decision was received. The complaint can be submitted on paper or electronically via the e-Otinish platform.<\/p>\n

The review procedure depends on the format of the initial assessment. When the results of an in-person assessment are appealed, the reassessment is carried out by the MSA Methodology and Control Department.<\/p>\n

Specialists study the medical documents and examine the citizen.<\/p>\n

If necessary, specialist consultants \u2013 including cardiologists, oncologists, ophthalmologists, paediatricians and psychologists \u2013 are involved to clarify the diagnosis and the degree of impairment of body functions.<\/p>\n

If a citizen disagrees with the results of a remote proactive assessment, the complaint is filed with the territorial department at their place of permanent registration. The documents are sent for review to the MSA Methodology and Control Department of another region. The review is carried out remotely on the basis of anonymised medical data.<\/p>\n

In this format, the assessment decision is issued within five working days from the date the MSA report is received by the relevant department. This period applies to the stage of expert review of the documents. Under Article 99 of the Administrative Procedural Code of the Republic of Kazakhstan, the total period for considering a complaint is 20 working days from the date of its registration, unless otherwise provided by the laws of the Republic of Kazakhstan.<\/p>\n
